penalties

First Offense
$500 -or- 48 hours up to 30 days
6 months suspension

Second Offense
$2000-$5000
48 hours up to 1 year
10 days public service
1 year suspension

REFUSAL - If an individual does not take the sobriety test or give samples for testing...
Individual's driver's license MUST be suspended for 90 days.

The refusal will be used against individual in court.

BAC of .15 or Above
Individual's driver's license will be suspended for at least 30 days.

Individual will need to request an administrative hearing within 10 days after the notice of suspension.

Individual will need to enroll in an Alcohol and Drug Safety Action Program(ADSAP) within 10 days after the notice of suspension.

Driver's license will be suspended for 3 months.

Must enroll in Alcohol and Drug Safety Action Program(ADSAP) within 10 days.

Apply for a provisional driver's license at the S.C. Highway Department.

REFUSAL results in 6 months suspension.
